Curfew Class Action Announcement
Bevan-Rhys James is taking the lead on the landmark Curfew Class Action matter.
The Honourable David Davis (Member of Legislative Council) sought the release of Freedom of Information documentation related to the nightly curfew in 2020 imposed across Melbourne.
The FOI documents revealed that Melbourne's strict 2020 COVID-19 nightly curfew was initiated by the state Cabinet, not by health authorities, and was announced before any formal written public health advice was presented to justify it.
Bevan-Rhys James has been approached to represent a lead plaintiff alleging that the curfew was imposed without lawful authority by the State of Victoria and seeks damages for false imprisonment on behalf of persons (group members) who were subject to the curfew.
The allegations have not been determined by the Court.
This matter relates to Victorians impacted by the nightly curfews.
